Should I disclose expunged charges (not conviction, no plea) to Prime Inc?

by Garry
(Altoona, PA)

Five years ago I was charged with small marijuana possession, paraphernalia, and receiving stolen property. The stolen property was a street sign i had since i was a teenager. I entered Pennsylvania's ARD program and after completing probation the charges were dropped and expunged.

I never had to plead guilty or no contest, the program started after my preliminary hearing and took place outside of the normal court system.

I have already applied for Prime's student driver program and am looking to go to orientation in two weeks. The application only asks for convictions and charges that you plead guilty or no contest to. I shouldn't have any record at this point.

So if Prime asks me when I get down there whether I've ever been arrested or not, should i answer yes?

Same situation here. Went thru ARD in PA...now expundged. My lawyer says you aren't obligated to say yes to anything.

No u havent been arrested...no to everything. The program is there to give good people that made a stupid mistake a second chance.

Don't open a can of worms. The less people know about your situation the better. Leave it in the past and obey the law. They won't go easy on you next time.

Seems to me if it is expunged that you shouldn't be obligated to make the ordeal known.

However, I am not a lawyer. You might want to ask one in your state about legalities. In your specific situation.

Best of luck Garry
