advice needed

I have a misdemeanor charge for possession of weed almost 3 years ago from right after my divorce. I have 4 kids which depend on me to take care of them.

I now have found a great person to spend my life with and that is there for the kids. I have been working as a day laborer and now there is no work and I would like to get my cdl and start a new career that allows me to take care of my family.

Does anyone have any advice about how to get into a school and company to work for. I have applied at the companies that provide the training but have not heard back from any of them.

CR England is cuel and unusual punishment

I got a 5 year old marihuana charge. I've been driving a while but I'm still stuck with England which is cruel and unusual punishment for the conviction but I never inhaled so that's the difference between us.

Applicants should not disclose marijuana convictions older than (2) two years for quantities of 28.5 grams or less (other than concentrated cannabis) per California Health & Safety Code §§11357(b) or (c), 11360(b) (formerly subdivision (c) of section 11360), 11364, 11365, or 11550.

Applicants should not disclose convictions that have been sealed, expunged, or statutorily eradicated or any misdemeanor convictions for which probation has been successfully completed or otherwise discharged and the case has been judicially dismissed.

Applicants should not disclose information regarding arrests or detentions for which a diversion program has been successfully completed. Cal. Code Regs., tit. 2, § 7287-.4.

Applicants shall not disclose records of arrest, indictment, information, misdemeanor complaint, or conviction of a crime that, from the date of disposition, release, or parole, antedate the report by more than (7) seven years.

Petition the court for diversion

Another thing you need to know is you can petition the court for diversion if its your only offense. This was passed through the Supreme Court. My advice is to go to SWIFT do good and get your experience. If you have time petition for diversion. Doors will open my friend.

Don't get discourage u may have to find a small company to hire cause they do case by case. I have felonies too I talk to some of the small companies they said they would hire a felon but u got to present ur self to them that u don't life that life style no more its a lot of hard work but if u dedicated to u will succeed.

get the charge expunged

that is what you need to do...and if that is all that is on your record it is easy...

go to court of conviction and get the charge expunged from your record.

I think it is hard to get a job in trucking with a record now. However, my trucker has an old record, and he has 25 years experience long haul and has owned his own company until the bad economy hit, still company's would not accept him, so he went independent contractor and went to his buddies company and was hired day one.

In your case no experience doesn't help...I am sorry it is what it is. So I would like to suggest that since you have kids and they are in your custody, there are many programs that the state and government has to help you families without jobs, try that out for the meantime you can find out about the help through the Social Services dept in your area and county....food, housing, medical, cash grants, jobs etc....
