Can a person be held responsible if their dac report comes back clean but they have a record?

What should a person do that has a criminal record, but his dac report is coming back clean? Should they make mention of their record on their application, so that the employer won't get them for falsifying information?(my story)

there is disclosure and deception. i wouldnt decieve but i also wouldnt disclose if not asked. in other words as an attorney might tell you, DONT VOLUNTEER ANY INFO,
if they dont run a criminal backround then dont volunteer anything. if they ask about a specific occorence then br very brief about it and dont deny that specific occorence,

OK, first off, a DAC report and criminal record are 2 different things. Info on a DAC is reported to them by trucking companies, AFTER you leave. And it only pertains to your record while there. Your criminal record is archived by the courts system (County/State). So, in plain English, criminal records are not noted on your DAC report. You need to mention it when applying. Jimmy

Hey,hervy first of all let me say thank you for your comment and for being honest with me about this situation.Hervy on most of the applications they ask have you ever been convicted of a felony, and I have been convicted of one almost one and half year ago but when I applied for my dac report it came back clean and then my career service adviser applied for it electronically and she let me know that it's still coming back clean.

So I asked her what do she recommend, and she suggested for me to apply and not make mention of the charge but if they find it just tell them that I thought that the charges was expunged and never apply to them again, do anyone think that this is credible advice?

You can be held liable for not telling the truth on the ap if they find out. If it was over 10 years old it shouldn't show up on the DAC. Does the application ask back for a certain number of years or your total background.
