First offender fail

first off i have never plead guilty or been convicted of a felony i have been arrested 2 for felons one the disposition no bill they took me in for questioning and released me,second felony i did the whole court thing and got an successful discharge this was a possession of cocaine.

Now im a truck driver. there this company name hireright/usis and when i go to apply for trucking jobs they give trucking companys my background history and everything shows up the trucking companies will not hire me because im a first offender although i've never been convicted.

I live in Georgia and have read first offenders cannot receive pardons because that rights have already be restored okay,now i've read first offenders can not have there records expunged for what ever reason.

Finally a first offender is supposedly to be sealed only viewable by law enforcement or what not righ.

WELL A TRUCKING COMPANY IS NOT LAW ENFORCEMENT AND ON MY DIS CHARGE PAGE STATES UNDER GA CODE 42-8-60 a-E THIS DISCHARGE MAY NOT BE USED TO DISQUALIFY A PERSON IN ANY APPLICATION FOR EMPLOYMENT IN EITHER THE PUBLIC OR PRIVATE SECTOR,THE DISCHARGE SHALL COMPLETELY EXONERATE THE DEFENDANT OF ANY CRIMINAL PURPOSE

SO AM I SUPPOSE TO DO BECAUSE FROM WHAT MY DISCHARGE STATES AND THE GEORGIA CODE SEEMS LIKE IM GETTING A VIOLATED ANYBODY GOT ANY SUGGESTIONS

Discharged First Offender still shows NEW

I am dealing with the same thing. GCIC has sealed my completed/discharged First Offender. But the background check company Easy Backgrounds is still reporting it, though as Discharged. They use a court runner. I spoke to a woman there and explained it all, she said if they go digging for it and find it they will report. Appears there is a black hole here.

did you get that interview while on the ga 1st offender acting or are you off the georgia 1st offenders act. Can you apply for a job while on the georgia 1st offenders act? Write me back I'm trying to get back on the road.

was up world back again landed a job with ptl and dac has corrected info on my background check guess its really not dac doin damage just the bad companys and whatever resources that put that bad info on you so to all my drivers and future drivers be safe and protect yourself anything possible 18 wheels rollin always im leavin tommorrow for orientation 11/19/11

first offender getting penalized in GA

DfromGA, sounds like your getting some traction man. Thanks for letting us know how its going down out in GA.

Your doing the right thing. If they are not playing by the rules, let them know you are not sleep on it.

Well to inform everyone im on top of situation i got on the phone with GEorgia Crime center myself and was told that my first offender felony has been sealed away from public view the i got on the phone with hireright and i faxed them my discharge papers so theyll take the crap off my application so now im playin the wait game also got a truck ing in the process of hiring after review of the felonys and i sent them my discharge papers and explained that my records are seal and they should not show up and how hireright is a 3rd party company that illegaly obtains information about people and put it out there and about somethings they are tell in employers are not valid and outdated so i think i got em by the balls fellows i will keep all updated but in the mean while if you are a firtst offender once completed your po petions the court for discharge this discharge for me got sent to atlanta for them to update information and seal my record also they should give a copy as well now if hireright does not take this out im thinkn about seeking legal action

SHT happens

you must understand that those that run trucking now a days are sheep.what you are going through is more or less a child with a scalpel,no not a knife
most of the sheep hate trucking and are given jobs that can do a lot of damage see my post and I did not have felony and your post sound a lot like mine so SHT happens try a small mom and pop trucking outfit and above all else don't give up I know it's hard

Well if you are in a right to work state they can do what they want hire a labor lawyer. And go to the employment security commission. If it is not on my record or dac I would not tell any prespective employers.
