on the criteria of the wreck.

there are three things that always means a piss test, no matter who is at fault.
These are federal regulations and does not matter what state you are in.

Death
if vehicle towed
If someone is injured and requires medical attention.

under any of these circumstances you will test,
or the company can demand it that the driver works for.

refusing to take the test is an AUTOMATIC FAILURE.

If not taken within 24 hours of the accident THAT IS SEEN AS A REFUSAL TO TEST AND IS AN AUTOMATIC FAILURE.
